Sales tax on appliance repair

Repair labor is generally not taxed here (parts still are). The honest headline for a Malaysian homeowner is the opposite of what most tax summaries imply: repairing the air conditioner fixed to your house is not subject to service tax. Malaysia does not have VAT or GST. It runs a Sales and Service Tax system, and service tax applies only to services that are specifically prescribed as taxable. Maintenance or repair services were brought into that prescribed list with effect from 26 February 2024, at the same time as the general service tax rate rose from 6% to 8%. On its face that captured air-conditioning servicing. The Ministry of Finance and the Royal Malaysian Customs Department then carved residential work back out, through Service Tax Policy 5/2024, published by the Royal Malaysian Customs Department on 1 April 2024 and effective from 1 March 2024. The test is whether the thing being repaired is fixed to the structure of the residential building: repair and maintenance of items or equipment attached to or forming part of a residential premise, with air conditioners named explicitly alongside lifts and water heaters, is not subject to service tax. Repair and maintenance of moveable items inside a residential building remains taxable. For a Malaysian household that draws a clear and slightly odd line - servicing the wall-mounted split in the bedroom falls outside service tax, while servicing a portable or free-standing unit that is not attached to the building does not. Sinking-fund and building-maintenance charges levied by a developer, joint management body or management corporation on residential owners are also outside the tax. Two qualifications keep this from being a blanket exemption. It is a residential rule: the same repair on an office, a shoplot, a factory or a rented commercial unit is a taxable service at 8%. And it is a service-tax rule only - it does not touch the sales tax already embedded in the price of the compressor, board or refrigerant the contractor buys, which the contractor recovers inside the parts price whether or not service tax appears on the invoice. The registration threshold matters as much as the exemption. Service tax is charged only by a registered person. The 2024 amendment placed maintenance and repair services in Group G of the service tax regulations, and the Customs Department's own registration guidance puts the Group G threshold at RM500,000 of taxable services supplied in a twelve-month period. Most Malaysian residential aircond servicing is done by small operators nowhere near that figure, so even in the taxable cases many homeowners will never see service tax itemised. Combine the two rules and the practical answer for an ordinary Malaysian home is that the price quoted for a wall-split service or repair is the price, with no 8% to be added. One further point about how current this information is. Malaysia's service tax scope has changed repeatedly - the rate rise and the maintenance-and-repair expansion in 2024, a broad scope expansion on 1 July 2025 covering construction, rental and leasing and other sectors, and further policy clarifications in 2026 dealing with maintenance charges raised by joint management bodies. None of those later changes appears to reverse the residential fixed-equipment position described here, but a Malaysian contractor's own tax status is the thing to confirm on the invoice rather than assume from a guide.

Licensing & certification

Malaysia has no licence that is specifically an air-conditioning technician's licence, and that absence is the single most useful fact for a homeowner comparing quotes: the person who arrives to service a split unit is not, in the ordinary case, required to hold any personal government certificate for the aircond work itself. What is regulated is the electrical side. The Energy Commission, Suruhanjaya Tenaga, certifies Electrical Competent Persons and states the requirement in one line: "Individuals who wish to carry out, supervise or take responsibility for electrical works and installations in Malaysia must be certified as Electrical Competent Persons by the Energy Commission." The Commission lists six categories - Cable Jointers, Electrical Services Engineers, Chargeman, Electrical Engineers, Electrical Supervisors and Wireman - and the one that matters for domestic work is the Wireman, whose published entry requirements include two years of electrical wiring experience with an electrical contractor or a private wiring unit registered with the Commission, along with knowledge of the Electricity Supply Act 1990 and its regulations. The underlying framework is that Act together with the Electricity Regulations 1994, and electrical contracting firms register with the Commission separately from the individuals they employ. In practice the line falls where the wiring starts. Cleaning, gas top-up, board replacement and fault-finding on an existing unit sit outside the Commission's competent-person scheme, whereas running a new dedicated circuit from the distribution board, altering the fixed wiring or installing an isolator is electrical installation work and belongs to a certified competent person working for a registered contractor. A homeowner who is having a first-time installation done, rather than a service on an existing machine, is the one who should be asking to see registration. Two further points, stated with their limits. Larger installation contracts in Malaysia bring in Construction Industry Development Board registration for the contracting firm, which is a business registration rather than a technician's qualification. And on refrigerant, no Malaysian scheme requiring an individual domestic aircond technician to hold a personal refrigerant-handling certificate has been identified in a primary Malaysian regulator source. Malaysia is a Montreal Protocol party and refrigerant import and use is controlled through the Department of Environment under the Environmental Quality Act 1974, but that is control of the substance and of the businesses that trade in it, and it should not be reported as a personal certification requirement without a regulator source confirming one. Treat that as an unconfirmed point rather than as a finding that no such requirement exists.
